Terms and Conditions – Online Store

These Terms and Conditions (“Terms”) govern your use of this website and all
purchases made through our online shop (“the Store”). By accessing the website or
placing an order, you agree to be bound by these Terms. If you do not agree, please
refrain from using the website.

4. Products and Availability

All products displayed are subject to availability. We reserve the right to limit quantities, discontinue products, or cancel orders at our discretion.
We take reasonable care to ensure that product descriptions, images, and pricing are accurate. However, errors may occur, and we reserve the right to correct such errors without liability. Images are for illustrative purposes only and may not always reflect the exact product.

5. Pricing

All prices are listed in South African Rand (ZAR) and include VAT unless otherwise
stated. Prices may change without prior notice.

6. Orders

Placing an order constitutes an offer to purchase. We reserve the right to accept or
reject any order. An order is confirmed only once payment has been received and a
confirmation email has been issued.
If installation is required, an additional quotation may be provided. Ownership of goods remains with the seller until full payment is received; however, risk transfers to the customer upon delivery. Lead times vary depending on product availability and production schedules. Minimum lead time is 1–2 weeks. All items available on the store, including special-order items, are
made to order. Any returns must comply with the applicable returns policy.

7. Payment

We accept payment through approved payment gateways. All transactions are
processed securely, and we do not store card details.

EFT payments are subject to bank clearance. Cash deposit fees are payable by the purchaser. Any alterations or modifications to items will require a separate invoice. Modifications will only commence once payment has been made in full, and upon signed agreement and drawing acceptance. Any modified or customised items are non-refundable, as they are non-stock items.

8. Shipping and Delivery

Delivery timelines are estimates and may vary due to factors beyond our control. We are not responsible for delays caused by couriers or incorrect delivery information provided by the customer. Delivery costs may vary based on location, order size, and weight. Standard delivery charges are shown at checkout; however, larger shipments may incur additional fees. Minimum shipping fees apply.

9. Returns and Refunds

We comply with the Consumer Protection Act (CPA) of South Africa. Customers may return goods within 7 days of delivery if the product is defective, damaged, or not as described. Refunds are processed once returned goods have been inspected and approved. Items must be unused and in their original packaging unless the return relates to a defect. This Returns & Refunds Policy forms part of our Terms and Conditions and aligns with the CPA.

10. Cancellations

Orders may be cancelled prior to dispatch. Once dispatched, the order will be treated as a return. Cancellations may be subject to a 10% handling fee. The delivery fee is not refundable.

11. Intellectual Property

All website content—including images, logos, text, and graphics—is the property of the business and may not be reproduced without written permission.

12. User Conduct

You agree not to misuse the website, attempt unauthorised access, or engage in any activity that disrupts the operation of the Store.

13. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or
consequential damages arising from the use of this website or products purchased.
Warranty Coverage.  All products include a 12-month limited warranty from the date of delivery, covering defects in materials and workmanship under normal use.

What’s Covered:

- Manufacturing defects
- Faulty materials
- Product failure not caused by misuse

What’s Not Covered:

- Normal wear and tear
- Damage from misuse, accidents, or improper care
- Unauthorized modifications or repairs
- Cosmetic damage not affecting functionality

How to Make a Warranty Claim:

Email sales@ese-sa.co.za with:
- Your order number
- Description of the issue
- Photos or videos showing the defect
Once assessed, we may repair, replace, or refund the item at our discretion.

Limitations:

The warranty is non-transferable and applies only to the original purchaser. It excludes incidental or consequential damages where permitted by law.

14. Privacy

Your personal information is processed in accordance with our Privacy Policy and the
Protection of Personal Information Act (POPIA).

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

16. Changes to These Terms

We may update these Terms at any time. Continued use of the website constitutes
